Terms of Service

1. Acceptance of Terms
By accessing, browsing, or using the LeakedSource website, application programming interfaces, and related services (collectively, the "Service"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must immediately discontinue use of the Service.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" and "your" shall include that organization.
2. Definitions
- "Breach Data" means personal information originating from third-party data breaches, security incidents, or credential-stealing malware, as indexed and made searchable through the Service.
- "Confidential Information" means all non-public information related to the Service, including but not limited to system architecture, API specifications, algorithms, data structures, business processes, pricing models, and proprietary methodologies.
- "Content" means all text, data, graphics, images, software, and other materials available through the Service, including Breach Data, breach summaries, and educational resources.
- "HEROIC" means HEROIC Holdings, LLC, the parent company and operator of LeakedSource.
- "Service" means the LeakedSource website at leakedsource.com, all associated subdomains, APIs, and related tools and features.
- "Subscription" means a paid plan that grants access to premium features, enhanced search capabilities, and additional Breach Data.
3. Service Description
LeakedSource is a data breach intelligence and monitoring service that enables individuals and organizations to determine whether their personal information has been exposed in known data breaches. The Service provides:
- Breach search capabilities across a database of known data breaches.
- Breach monitoring and notification for registered email addresses.
- A browsable index of known breach sources with metadata.
- Tiered access to breach record details based on subscription level.
The Service is intended for personal cybersecurity awareness and organizational security purposes only. It is designed to empower users to take protective action in response to data breaches affecting their own accounts and information.
4. User Accounts
4.1 Registration
Certain features of the Service require you to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate.
4.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us at [email protected] if you become aware of any unauthorized access to or use of your account.
4.3 Account Restrictions
Each account is for a single individual or entity. You may not share, transfer, or sublicense your account credentials to any third party. We reserve the right to suspend or terminate accounts that we reasonably believe are being shared or used in violation of these Terms.
5. Subscriptions & Payments
5.1 Free Tier
The free tier provides limited access to the Service, including a restricted number of daily searches and summary-level breach information. Free tier features and limitations are subject to change at our discretion.
5.2 Paid Subscriptions
Paid Subscriptions provide access to enhanced features, increased search limits, detailed breach records, stealer log data, and other premium capabilities as described on our Pricing page. Subscription features and pricing are subject to change; however, changes will not apply to your current billing period.
5.3 Billing and Renewal
Paid Subscriptions are billed on a recurring basis (monthly or annually, as selected). Your Subscription will automatically renew at the end of each billing period unless you cancel prior to the renewal date. You authorize us (via our payment processor, Stripe) to charge the payment method on file for all applicable fees.
5.4 Cancellation and Refunds
You may cancel your Subscription at any time through your account settings. Upon cancellation, your Subscription will remain active until the end of the current billing period, after which it will revert to the free tier. We do not provide prorated refunds for unused portions of a billing period, except as required by applicable law or at our sole discretion.
5.5 Price Changes
We reserve the right to change Subscription pricing. We will provide at least 30 days' advance notice of any price increase. If you do not agree to the new pricing, you may cancel your Subscription before the new price takes effect.
6. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You represent and warrant that:
- You will use the Service solely for your own personal cybersecurity awareness, or for the internal security purposes of an organization you are authorized to represent.
- You will not search for, access, or attempt to access Breach Data relating to individuals or organizations without a legitimate, lawful basis for doing so.
- You will comply with all applicable local, state, national, and international laws and regulations in connection with your use of the Service.
- You will not use the Service to facilitate, enable, or engage in any activity that violates the rights of any third party.
- Information you submit to the Service (including search queries) is accurate and you have a lawful basis for submitting it.
7. Prohibited Uses
The following uses of the Service are strictly prohibited. Violation of any of these provisions constitutes a material breach of these Terms and may result in immediate account termination and legal action:
- Unauthorized Access: Attempting to access another user's account, circumventing security measures, rate limits, or access controls, or probing the Service for vulnerabilities without written authorization.
- Credential Misuse: Using Breach Data to access third-party accounts, systems, or services (i.e., credential stuffing, password reuse attacks, or unauthorized logins).
- Harassment or Harm: Using Breach Data to harass, intimidate, threaten, extort, stalk, or otherwise harm any individual.
- Solicitation ("Ambulance Chasing"): Using Breach Data to target or solicit breach victims for commercial gain, including unsolicited marketing, sales pitches, or service offerings directed at individuals identified as breach victims.
- Credit and Employment Decisions: Using Breach Data as a factor in determining eligibility for credit, insurance, employment, housing, or any other purpose governed by the Fair Credit Reporting Act (FCRA) or similar legislation.
- Discrimination: Using Breach Data or the Service to discriminate against any individual based on race, color, religion, sex, national origin, age, disability, genetic information, or any other protected characteristic.
- Data Aggregation and Redistribution: Systematically downloading, scraping, or aggregating Breach Data for the purpose of creating a competing service, alternative database, or derivative dataset. This includes using automated tools, bots, or scripts to extract data in bulk.
- Reverse Engineering: Reverse engineering, decompiling, disassembling, or otherwise attempting to derive source code, algorithms, data models, or the underlying structure of the Service or any Confidential Information.
- System Interference: Introducing viruses, malware, or other harmful code; overloading, flooding, or deliberately degrading the performance of the Service; or interfering with any other user's use of the Service.
- Impersonation: Misrepresenting your identity or affiliation with any person or organization when using the Service.
- Benchmarking: Using the Service or any results to benchmark, evaluate, or compare the Service against any competing product or service, without prior written consent.
8. Intellectual Property
8.1 Ownership
The Service, including all software, algorithms, user interface designs, graphics, trademarks, logos, and Content (excluding User-submitted data and third-party Breach Data) is the exclusive property of HEROIC Holdings, LLC or its licensors and is protected by United States and international intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.
8.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes. This license does not include the right to:
- Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, or create derivative works from the Service or its Content.
- Use any data mining, robots, scraping, or similar automated data-gathering tools on the Service.
- Frame, mirror, or incorporate any portion of the Service into any other website, product, or service.
- Use the Service or its output to train artificial intelligence or machine learning models.
8.3 Feedback
If you provide feedback, suggestions, or ideas regarding the Service ("Feedback"), you grant us an irrevocable, perpetual, royalty-free, worldwide license to use, modify, and incorporate such Feedback into the Service without obligation to you.
9. Confidentiality
You acknowledge that in the course of using the Service, you may be exposed to Confidential Information, including but not limited to API structures, data formats, system architecture, algorithms, proprietary methodologies, and non-public business information.
You agree to:
- Maintain the confidentiality of all Confidential Information using at least the same degree of care you use to protect your own confidential information, but in no event less than reasonable care.
- Not disclose, publish, or disseminate Confidential Information to any third party without our prior written consent.
- Not reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, algorithms, or underlying structure from Confidential Information.
- Use Confidential Information solely for the purposes permitted under these Terms.
These confidentiality obligations do not apply to information that: (a) is or becomes publicly available through no fault of yours; (b) was known to you prior to disclosure; (c) is independently developed by you without use of Confidential Information; or (d) is required to be disclosed by law, provided you give us prompt written notice and cooperate with any efforts to obtain protective treatment.
Your confidentiality obligations under this section survive termination of your account and these Terms.
10. Breach Data Terms
10.1 Nature of Breach Data
Breach Data available through the Service originates from third-party sources, including publicly available data breach datasets, security research, and the HEROIC breach intelligence platform. LeakedSource does not create, originate, or independently verify the accuracy of individual Breach Data records.
10.2 No Guarantee of Completeness
The Service does not claim to provide a complete record of all data breaches. New breaches are discovered regularly, and there may be breaches of which we are not aware. The absence of results for a given search query does not constitute a guarantee that your information has not been compromised.
10.3 Sensitive Breach Data
Certain breach records may be classified as sensitive (e.g., breaches involving adult websites, health-related services, or political affiliations). Access to sensitive breach data may be subject to additional restrictions and verification requirements.
10.4 Data Masking
Certain sensitive fields within Breach Data are automatically masked or partially redacted. You agree not to attempt to circumvent, bypass, or defeat any data masking or redaction applied by the Service.
10.5 Responsible Use
You acknowledge that Breach Data may contain sensitive personal information belonging to third parties. You accept full responsibility for your use of Breach Data and agree to use it only for legitimate cybersecurity and personal protection purposes as permitted under these Terms.
11. Disclaimers
THE SERVICE, INCLUDING ALL CONTENT, BREACH DATA, FEATURES, AND FUNCTIONALITY, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEROIC HOLDINGS, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, CURRENCY, OR AVAILABILITY OF BREACH DATA OR ANY OTHER CONTENT;
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
- WARRANTIES THAT THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE, RELIABLE, OR COMPREHENSIVE;
- WARRANTIES THAT DEFECTS IN THE SERVICE WILL BE CORRECTED.
Breach Data originates from external, third-party sources. HEROIC is not responsible for the accuracy, currency, completeness, or reliability of any Breach Data record. Breach Data may contain errors, fabricated entries, parsing artifacts, or outdated information. You acknowledge and accept these limitations.
No information or advice, whether oral or written, obtained from us or through the Service shall create any warranty not expressly stated in these Terms.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HEROIC HOLDINGS, LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL;
- COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES;
- DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO, ALTERATION OF, OR LOSS OF YOUR DATA OR TRANSMISSIONS;
- DAMAGES ARISING FROM ANY THIRD PARTY'S USE OR MISUSE OF INFORMATION OBTAINED THROUGH THE SERVICE;
ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED FIVE HUNDRED UNITED STATES DOLLARS (US $500.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless HEROIC Holdings, LLC and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Service or any Breach Data obtained through the Service.
- Your violation of these Terms or any applicable law or regulation.
- Your violation of any third party's rights, including intellectual property, privacy, or contractual rights.
- Any misuse of your account, whether by you or any third party using your credentials.
- Any claim by a third party that arises from information you submitted to or obtained from the Service.
14. Termination
14.1 Termination by You
You may terminate your account at any time through your account settings or by contacting us at [email protected]. Termination does not entitle you to a refund for any prepaid Subscription fees, except as stated in Section 5.4.
14.2 Termination by Us
We reserve the right to suspend or terminate your account and access to the Service, without prior notice, for any reason, including but not limited to:
- Violation of these Terms or any applicable law.
- Conduct that we reasonably believe is harmful to other users, us, third parties, or the integrity of the Service.
- Extended periods of inactivity.
- Security concerns, including suspected unauthorized access.
14.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy. The following sections survive termination: Sections 8 (Intellectual Property), 9 (Confidentiality), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), and 15 (Governing Law).
15. Governing Law & Dispute Resolution
15.1 Governing Law
These Terms and any dispute arising out of or relating to the Service shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions.
15.2 Jurisdiction and Venue
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Utah, and you irrevocably consent to the personal jurisdiction and venue of such courts.
15.3 Informal Resolution
Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute within 30 days. If the dispute is not resolved within that period, either party may proceed with formal legal action.
15.4 Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND HEROIC AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found to be unenforceable, then the entirety of this dispute resolution section shall be null and void.
15.5 Statute of Limitations
Any claim or cause of action arising out of or related to these Terms or the Service must be filed within one (1) year after the claim arose, or the claim is permanently barred.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date and notify you through the Service (such as a banner notification) or via email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and, if applicable, cancel your Subscription.
17. General Provisions
17.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and HEROIC Holdings, LLC regarding the Service and supersede all prior agreements, understandings, and representations.
17.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
17.3 Waiver
No failure or delay by us in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. A waiver of any provision shall not constitute a waiver of any other provision.
17.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms, in whole or in part, without restriction.
17.5 Force Majeure
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government actions, power failures, internet disruptions, or third-party service outages.
17.6 Export Compliance
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable export control laws and regulations in connection with your use of the Service.
17.7 No Third-Party Beneficiaries
These Terms are for the benefit of you and HEROIC only. They do not create any third-party beneficiary rights.
17.8 Headings
Section headings in these Terms are for convenience only and shall not affect the interpretation of any provision.
